The following terms and conditions apply to your use of the Exquisite Living web site. Your use of the web site indicates your acceptance of these terms and conditions.

Orders/Pricing

Exquisite Living online is dedicated to your total satisfaction. Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

We may not be able to accept your order or part of your order due to one of the following reasons:
the product you ordered is out of stock; authorisation of your payment failed; we made a pricing or product description error or you are not eligible to order from Exquisite Living.
If there are any problems with your order, you will be contacted by a member of our Customer Services team.

Orders are normally processed within 24 hours, so we may have already packaged your order and made arrangements for it to be sent to you when you cancel it. If this is the case then we cannot always stop the order from being sent. Once you receive the order, you will have to return it to us.

• All pricing is in Australian dollars and inclusive of GST. Please note that pricing and stock availability are subject to change without prior notice. If an item is out of stock, Exquisite Living will contact you to either select an alternative product or offer a refund.
• In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Exquisite Living shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

• Exquisite Living reserves the rights to adjust product and freight costs on the web site at any time.

Gift Wrapping

Irresistible gifts are an Exquisite Living specialty. A unique selection of gifts for everyone ranging from the inexpensive to the luxurious are all available gift wrapped free of charge.

Payment

You can be assured of secure shopping at Exquisite Living. We have chosen PayPal, an eBay company because of it's worldwide reputation for security and service delivery. The PayPal Service is an online payment service currently available in 56 countries (including Australia), permitting any business or consumer with an email address and a credit card to securely, conveniently, and cost effectively send and receive payments online. The PayPal Service lets users send payments for free and can be used from PCs or Web-enabled mobile phones.

You do not need a PayPal account to be able to buy from Exquisite Living, because you can also just pay with your credit card without opening a PayPal account.

We accept online payment by credit card (MasterCard and VISA) and PayPal. Your personal information is protected by SSL (secure sockets layer) with the highest level of encryption commercially available to ensure that your transaction is safe and secure. All transactions are in Australian dollars (AUD$).

If you would prefer to pay by cheque or bank transfer instead, please use our Exquisite living order form. Your goods will be dispatched as soon as your funds have cleared in our bank account.

Delivery

We aim to dispatch your order within 24 hours of receipt, providing that goods are in stock. In the event that an item is temporarily out of stock, we will notify you of the delay and dispatch it as soon as it arrives.

An order can be delivered to one address only. If you require orders to be sent to multiple addresses you will need to place a separate order for each address. Orders are processed and shipped on working days only (Monday through Friday, excluding public holidays).

Deliveries within Australia
Goods will be delivered using Australia Post or a courier service and a signature will be required upon receipt of goods. Postage costs will be calculated at the checkout for deliveries within Australia
• Exquisite Living will contact you by email to let you know when an order has been dispatched.
• Customers are responsible to have someone at the delivery address to sign for and accept the delivery. For items sent by Australia Post, if you are not present a card will be left in your letterbox advising you to collect your parcel from your local post office. For courier services, if you are not present when a delivery takes place, a card will be left and you can re-arrange delivery on an alternative morning / afternoon of a specific day. Any additional costs for re-delivery attempts beyond this will be paid for by the customer.

Freight Charges for Furniture. Due to the many variations in the products we offer it is not practical to include freight in our furniture pricing, to obtain a quotation please contact us via email at This e-mail address is being protected from spambots. Once payment is cleared for furniture that is an ON ORDER PRODUCT, as indicated in the item description, the item will be ordered in for you. It may take up to 8 weeks to receive your item but in most cases it is quicker than this.

International Deliveries
We welcome overseas orders and are happy to ship around the globe. Customer Service will contact you with a quote for delivery charges. Overseas deliveries may be subject to local import duties and taxes which remain the responsibility of the customer. Exquisite Living will not be liable for any duties, taxes or customs charges placed on the goods at the point of import.

Returns/Refunds/Cancellations

We want you to be totally satisfied with every purchase you make. So if by any chance you wish to return an item, you can do so within 7 days of receipt of your goods. Customers must contact Exquisite Living for a returns acceptance number prior to agreement for any returns to take place. The Item must be returned complete, in perfect condition, unused, unwashed and in the original packaging. We will not exchange or refund items that are not in perfect condition or have been used or washed.. Shipping and handling cost are not refundable. The customer will be responsible for the cost of returning any item to Exquisite Living in its original condition to us at:

Exquisite Living advises all customers returning items to use a recorded or registered delivery, as we cannot be held responsible for items that may be lost or damaged in the post.
• If requested by Exquisite Living, the Customer may be required to provide information that we can use to assist the Customer with any monetary refund or return. This information may include your name, address, home phone, work phone, credit card details and other relevant information required by Exquisite Living. Failure to provide sufficient information may delay the refund process. Exquisite Living is not to be held responsible for any delays according to this clause
• In the unlikely event that stock is recalled by the manufacturer, Exquisite Living will pay all associated costs for return and refund
• There will be no credit given on order price difference, due to any price changes
• Any incorrect, missing or damaged items received must be reported to Exquisite Living within 24 hours of you receiving the delivery. This can be reported by email or phone
• If item(s) received is not what you ordered, please do not open the sealed packaging. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter

• Exquisite Living owns the title of any extra goods shipped with your order that have been dispatched in error

Liability

• Exquisite Living shall not be liable to the Customer, or to any other person whomsoever, for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the Products, other than expressly imposed by statute in terms of which it is not possible to limit or exclude liability

Disclaimer

• Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice
• Information contained throughout the web pages and in our database is believed to be accurate and reliable at the time of publishing. There may be misprints, human errors, and omissions. We reserve the right to make changes and corrections in prices, products, and specifications without notice
• Images and dimensions displayed on this web site should be regarded as illustrative and for informational purpose only. The actual products may vary slightly to the images and dimensions stated
• Exquisite Living may change the content of its terms and conditions at any time without prior notice.

Obligations of the Customer

• As a Customer of Exquisite Living, you must provide current, complete, and accurate information about yourself at all times

Sever Ability

• In the event that any part of these terms and conditions shall be deemed invalid, unlawful or un-enforceable to any extent, such terms or conditions shall be severed from the remaining terms and conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law

Governing Law

• Exquisite Living and the Customer agree that the terms and conditions of sale shall be governed by the laws of the State of New South Wales, Australia.

Privacy

We respect your privacy and appreciate your business. Exquisite Living collects customer data which is provided voluntarily by our customers to be used for marketing and promotional use only and at no time do we ever provide your account, contact or payment information to any third party vendor. Customers are only added to our email and mailing list if they opt to register. Customers have the option to be removed from the list at any time.
